Legal Requirements

People who supply, own and use LEV all have legal duties.

Employers of people being protect by the LEV have legal responsibilities under the Health and Safety at Work etc. Act 1974, the Control of Substances Hazardous to Health Regulations (COSHH) 2002 (as amended) and the Management of Health and Safety at Work Regulations 1999 (MHSWR).
There area also special provisions for employers in safety data sheets under REACH.

“Employers must ensure that thorough examination and testing of their ‘protective’ LEV is carried out at least every 14 months (unless otherwise stipulates), other engineering controls at suitable intervals and must review and revise ways of working so that controls are being used effectively.”

“Employees must use these control measures in the way they are intended to be used and as they have been instructed.”
